[Inheritance of Fetuses]

If one dies while there is a fetus (or fetuses) that would inherit from him or her, you reserve ¹¹⁷⁶ for them the greater of the inheritance of two males or two females; ¹¹⁷⁷ then you give all other heirs what is certainly theirs, and you keep the rest until (the outcome of the pregnancy) is clear. ¹¹⁷⁸

إِذَا مَاتَ عَنْ حَمْلٍ يَرِثُهُ، وَقَفْتَ لَهُ مِيْرَاثَ ذَكَرَيْنِ إِنْ كَانَ مِيْرَاثُهُمَا أَكْثَرَ، وَإِلاَّ مِيْرَاثَ أُنْثَيَيْنِ، فَتُعْطِيْ كُلَّ وَارِثٍ اْليَقِيْنَ، وَتَقِفُ اْلبَاقِيَ حَتَّى يَتَبَيَّنَ .

[Inheritance of the Missing Heir]

If one of the heirs is missing and his or her whereabouts are unknown, you give each of the other heirs their certain share; ¹¹⁷⁹ the rest will be reserved until his condition is known, ¹¹⁸⁰ unless he

وَإْنَ كَانَ فِيْ اْلوَرَثَةِ مَفْقُوْدٌ لاَ يُعْلَمُ خَبَرُهُ، أَعْطَيْتَ كُلَّ وَارِثٍ اْليَقِيْنَ، وَوَقَفْتَ اْلبَاقِيَ حَتَّى يُعْلَمَ حَالُهُ، إِلاَّ

1176. This is done when the heirs insist on dividing the estate before the birth. It is preferred that they wait until they know the outcome of the pregnancy. (-M): they must wait until they know the outcome of the pregnancy.

1177. Delivering more than two babies is rare, but if there are more than two, then the fetuses can still obtain their full inheritance from the other heirs even after the distribution.

1178. If the outcome of the pregnancy is a stillbirth, there will be no inheritance for the fetus, who only inherits if born alive because the Messenger of Allah (SA) said:

“If the newborn cries (indicating life), he or she inherits.” (D – from Abu Hurayrah. al-Albâni: Auth)

إِذَا اسْتَهَلَّ الْمَوْلُودُ وَرِثَ

Showing any sign of life will be treated like crying.

1179. The lesser amount of what they would get in the case of his life or death. In certain cases, someone may inherit more in the presence of a certain co-heir. For example, if someone was survived by 2 daughters, 1 brother, 1 son’s daughter and her missing brother, then that son’s daughter will inherit with her brother as a co-residuary heir. However, if he is dead, the deceased’s brother will be the residuary heir, and she will not inherit from her grandfather.

1180. There are two reports from (A) concerning the period of waiting for one who goes missing in a non-perilous situation:

goes missing in perilous circumstances, in which case you wait four years, and then his share will be divided. ¹¹⁸¹

أَنْ يُفْقَدَ فِيْ مَهْلَكَةٍ أَوْ مِنْ بَيْنِ أَهْلِهِ، فَيُنْتَظَرُ أَرْبَعَ سِنِيْنَ ثُمَّ يُقْسَمُ.

[Divorce during Terminal Illness]

If he divorces his wife while he is terminally ill, in a manner that makes his divorce suspected of being intended to deprive her of inheritance, she is still entitled to the inheritance as long as she is in her waiting period. ¹¹⁸² If the divorce is unfinalized (raj‘iy), they inherit from each other during the waiting period, whether he divorces her while in a state of health or terminal illness.

وَإِنْ طَلَّقَ اْلمَرِيْضُ فِيْ مَرَضِ اْلمَوْتِ اْلمَخُوْفِ امْرَأَتَهُ، طَلاَقًا يُتَّهَمُ فِيْهِ بِقَصْدِ حِرْمَانِهَا اْلمِيْرَاثَ، لَمْ يَسْقُطْ مِيْرَاثُهَا، مَادَامَتْ فِيْ عِدَّتِهِ. وَإِنْ كَانَ الطَّلاَقُ رَجْعِيًّا، تَوَارَثَا فِيْ اْلعِدَّةِ، سَوَاءٌ كَانَ فِيْ الصِّحَّةِ أَوِ الْمَرَضِ

[Acknowledgment of Disputed Lineage]

If all the heirs acknowledge the presence of a co-heir who agrees with them, or is young and of unknown

وَإِنْ أَقَرَّ اْلوَرَثَةُ كُلُّهُمْ بِمُشَارِكٍ لَهُمْ فِيْ

1) Wait until the person would have reached the age of 90 years, or

2) Wait indefinitely until it is certain that the person has died; this is left for the court to decide.
This may be one of the issues that can be subjected to new ijtihâd considering the recent changes in the world. Additionally, the judgments of the Companions in this regard pertained to individual circumstances (waqâ’i‘ a‘yân) that do not have the power of generalization as do the texts of revelation. Many of the laws in Muslim countries have attempted to lighten the burden of the family members, particularly the wives, of missing persons.
If it cannot be determined whether the missing person died before or after the death of the person whose estate is being divided, you will assume that the missing person died before. This is because the missing person’s being alive at the time of the deceased’s death is a condition for his or her inheriting.

1181. Zakat on the estate left for the missing will be paid from it before it is divided among the heirs, as explicitly stated by Aḥmad (may Allah have mercy on him).

1182. (A/SM): If she did not marry or apostatize, she would still inherit him even if he dies after the end of her waiting period.

lineage, then his or her attribution to the deceased and inheritance from the deceased is established. If only some of the heirs admit this, the attribution to the deceased is not established. ¹¹⁸³ Still, he or she will get the difference between 1) the (received) share of inheritance of those heirs who admitted it, and 2) the (presumptive) share had he or she been eligible for inheritance. ¹¹⁸⁴

اْلمِيْرَاثِ فَصَدَّقَهُمْ، أَوْ كَانَ صَغِيْرًا مَجْهُوْلَ النَّسَبِ، ثَبَتَ نَسَبُهُ وَإِرْثُهُ، وَإِنْ أَقَرَّ بَعْضُهُمْ، لَمْ يَثْبُتْ نَسَبُهُ، وَلَهُ فَضْلُ مَا فِيْ يَدِ الْمُقِرِّ عَنْ مِيْرَاثِهِ.

1183. Unless two trustworthy witnesses, from the heirs or others, testify that the individual was born to the deceased, or the deceased admitted to fathering him or her. In those cases, the attribution will be established.

1184. Example: The deceased is survived by 2 sons. One son admits the deceased’s paternity of a third son, while the other son denies it. The one who denies it gets 1/2 of the estate, the one who admits it gets 1/3 (which is what he would have gotten had the disputed paternity been established), and the disputed son gets 1/6 (the difference between the 1/2 and the 1/3).

The Inheritance of People Who May Have All Died at Once (e.g., Drowning/Fire/Under the Rubble)

الغَرْقَى والحَرْقَى والهَدْمَى

(This topic was not addressed in the matn of al-‘Umdah, so it may be appropriate to add it under this chapter.)
There are three scenarios:

1. If we know who died first, then the one who died later inherits from the one who died first.

2. If we know that they died all at once, then they do not inherit from one another.

3. If we do not know who died first, then:

a) If the heirs do not make claims regarding who died first, they inherit from one another, but they inherit from the original estate (as it was before they both died). So A inherits from B, and B inherits from A, but B inherits from A’s estate without adding A’s inheritance from B. This is to avoid falling into an infinite loop.

b) If the heirs make claims but fail to prove them, and then the heirs take oaths, neither one of the deceased individuals inherits from the other.

Chapter on Allegiance (to the Emancipator) ¹¹⁸⁵

باَبُ اْلوَلاَءِ

اْلوَلاَءُ لِمَنْ أَعْتَقَ ، وَإِنِ اخْتَلَفَ دِيْنُهُمَا؛ لِقَوْلِ رَسُوْلِ اللهِ :"إِنَّمَا اْلوَلاَءُ لِمَنْ أَعْتَقَ" وَإِنْ عَتَقَ عَلَيْهِ بِرَحِمٍ أَوْ كِتَابَةٍ أَوْ تَدْبِيْرٍ أَوِ اسْتِيْلاَدٍ، فَلَهُ عَلَيْهِ اْلوَلاَءُ ، وَعَلىٰ أَوْلاَدِهِ مِنْ حُرَّةٍ مُعْتَقَةٍ أَوْ مِنْ أَمَتِهِ، وَعَلىٰ مُعْتِقِيْهِ وَمُعْتَقِيْ أَوْلاَدِهِ وَأَوْلاَدِهِمْ وَمُعْتِقِهِمْ، أَبَدًا مَا تَنَاسَلُوْا ، وَيَرِثُهُمْ إِذاَ لَمْ يَكُنْ لَهُ مَنْ يَحْجُبُهُ عَنْ مِيْرَاثِهِمْ ، ثُمَّ عَصَبَاتُهُ مِنْ بَعْدِهِ . وَمَنْ قَالَ: أَعْتِقْ عَبْدَكَ عَنِّيْ وَعَلَيَّ ثَمَنُهُ فَفَعَلَ، فَعَلىٰ اْلآمِرِ ثَمَنُهُ، وَلَهُ وَلاَؤُهُ، وَإِنْ لَمْ يَقُلْ: عَنِّيْ، فَالثَّمَنُ عَلَيْهِ وَاْلوَلاَءُ لِلْمُعْتِقِ ، وَمَنْ أَعْتَقَ عَبْدَهُ عَنْ حَيٍّ بِلاَ أَمْرِهِ أَوْ عَنْ مَيِّتٍ، فَاْلوَلاَءُ لِلْمُعْتِقِ ، وَإِنْ أَعْتَقَهُ عَنْهُ بِأَمْرِهِ فَاْلوَلاَءُ لِلْمُعْتَقِ عَنْهُ بِأَمْرِهِ ، وَإِذاَ كَانَ أَحَدُ الزَّوْجَيْنِ اْلحُرَّيْنِ حُرَّ اْلأَصْلِ، فَلاَ وَلاَءَ عَلىٰ وَلَدِهَمَا ، وَإِنْ كَانَ أَحَدُهُمَا ، رَقِيْقًا، تَبِعَ اْلوَلَدُ اْلأُمَّ فِيْ حُرِّيَّتِهَا أَوْ رِقِّهَا، فَإِنْ كَانَتِ اْلأُمُّ رَقِيْقَةً، فَإِنْ أَعْتَقَهُمْ، فَوَلاَؤُهُمْ لَهُ وَلاَ يَنْجَرُّ عَنْهُ بِحَالٍ ، وَإِنْ كَانَ اْلأَبُ رَقِيْقًا وَاْلأُمُّ مُعْتَقَةً، فَوَلَدُهَا أَحْرَارٌ وَعَلَيْهِمُ اْلوَلاَءُ لِمَوْلىَ أُمِّهِمْ ، فَإِنْ عُتِقَ اْلعَبْدُ، جَرَّ مُعْتِقُهُ وَلاَءَ أَوْلاَدِهِ، وَإِنِ اشْتَرَى أَحَدُ اْلأَوْلاَدِ أَباَهُ، عَتَقَ عَلَيْهِ ، وَلَهُ وَلاَؤُهُ وَوَلاَءُ إِخْوَتِهِ، وَيَبْقَى وَلاَؤُهُ لِمَوْلىَ أُمِّهِ، فَإِنْ اشْتَرَى أَبُوْهُمْ عَبْدًا فَأَعْتَقَهُ ثُمَّ مَاتَ اْلأَبُ فَمِيْرَاثُهُ بَيْنَ أَوْلاَدِهِ لِلذَّكَرِ مِثْلُ حَظِّ اْلأُنْثَيَيْنِ ، فَإِذاَ مَاتَ عَتِيْقُهُ بَعْدَهُ، فَمِيْرَاثُهُ لِلذُّكُوْرِ دُوْنَ اْلإِنَاثِ ، وَلَوِ اشْتَرَى الذُّكُوْرُ وَاْلإِناَثُ أَبَاهُمْ فَعَتَقَ عَلَيْهِمْ ،ثُمَّ اشْتَرَى أَبُوْهُمْ عَبْدًا فَأَعْتَقَهُ، ثُمَّ مَاتَ اْلأَبُ، ثُمَّ مَاتَ عَتِيْقُهُ، فَمِيْرَاثُهُمَا عَلىٰ مَا ذَكَرْناَ فِي الَّتِيْ قَبْلَهَا ، وَإِنْ مَاتَ الذُّكُوْرُ قَبْلَ مَوْتِ اْلعَتِيْقِ، وَرِثَ اْلإِنَاثُ مِنْ مَالِهِ بِقَدْرِ مَا أَعْتَقْنَ مِنْ أَبِيْهِنَّ ، ثُمَّ يُقْسَمُ اْلبَاقِيْ بَيْنَهُنَّ وَبَيْنَ مُعْتِقِ اْلأُمِّ، فَإِنِ اشْتَرَيْنَ نِصْفَ اْلأَبِ، وَكَانُوْا ذَكَرَيْنِ وَأُنْثَيَيْنِ، فَلَهُنَّ خَمْسَةُ أَسْدَاسِ الْمِيْرَاثِ، وَلِمُعِتِقِ اْلأُمِّ سُدُسُهُ؛ لِأَنَّ لَهُنَّ نِصْفَ اْلوَلاَءِ ،وَاْلبَاقِيْ بَيْنَهُنَّ وَبَيْنَ مُعْتِقِ اْلأُمِّ أَثْلاَثاً، وَإِنِ اشْتَرَى ابْنُ اْلمُعْتَقَةِ عَبْدًا فَأَعْتَقَهُ، ثُمَّ اشْتَرَى اْلعَبْدُ أَبَا مُعْتِقِهِ، فَأَعْتَقَهُ جَرَّ وَلاَءَ مُعْتِقِهِ، وَصَارَ كُلُّ وَاحِدٍ مِنْهُمُا مَوْلىَ اْلآخَرِ ، وَلَوْ أَعْتَقَ اْلحَرْبِيُّ عَبْدًا، فَسَبَاهُ اْلعَبْدُ وَأَخْرَجَهُ إِلىٰ دَارِ اْلإِسْلاَمِ، ثُمَّ أَعْتَقَهُ، صَارَ كُلُّ وَاحِدٍ مِنْهُمَا مَوْلىٰ اْلآخَرِ .

1185. In this chapter, Imam Ibn Qudâmah discusses the concept of walâ’ (patronage/allegiance) extended to the emancipators, which entitles them to inherit from their freed slaves who have no heirs. The details in this chapter are about the conditions that will make walâ’ valid. Please refer to the appendix on slavery.

Chapter on Inheritance Through Allegiance (to the Emancipator) ¹¹⁸⁶

باَبُ اْلمِيْرَاثِ بِالْوَلاَءِ

اْلوَلاَءُ لاَ يُوْرَثُ ، وَإِنَّمَا يَرِثُ بِهِ أَقْرَبُ عَصَبَةِ اْلمُعْتِقِ ، وَلاَ يَرِثُ النِّسَاءُ مِنَ اْلوَلاَءِ ، إِلاَ مَا أَعْتَقْنَ ، أَوْ أَعْتَقَ مَنْ أَعْتَقْنَ، وَكَذٰلِكَ كُلُّ ذِيْ فَرْضٍ إِلاَّ اْلأَبَ وَاْلجَدَّ لَهُمَا السُّدُسُ مَعَ اْلاِبْنِ وَابْنِهِ ، وَاْلوَلاَءُ لِلْكُبْرِ ، فَلَوْ مَاتَ الْمُعْتِقُ وَخَلَّفَ ابْنَيْنِ وَعَتِيْقَهُ، فَمَاتَ أَحَدُ اْلاِبْنَيْنِ عَنْ ابْنٍ، ثُمَّ مَاتَ عَتِيْقُهُ، فَمَالُهُ لاِبْنِ اْلمُعْتِقِ ، وَإِنْ مَاتَ اْلابنانِ بَعْدَهُ وَقَبْلَ مَوْلاَهُ، وَخَلَّفَ أَحَدُهُمَا ابنا وَخَلَّفَ اْلآخَرُ تِسْعَةً، فَوَلاَؤُهُ بَيْنَهُمْ عَلىٰ عَدَدِهِمْ، لِكُلِّ وَاحِدٍ عَشَرَةٌ ، وَإِذاَ أَعْتَقَتِ اْلمَرْأَةُ عَبْدًا ثُمَّ مَاتَتْ، فَوَلاَؤُهُ وَعَقْلُهُ عَلىٰ عَصَبَتِهَا.

The Book of Emancipation

كتاب اْلعِتْقِ

وَهُوَ: تَحْرِيْرُ اْلعَبْدِ ، وَيَحْصُلُ بِاْلقَوْلِ وَاْلفِعْلِ ، فَأَمَّا اْلقَوْلُ، فَصَرِيْحُهُ لَفْظُ اْلعِتْقِ وَالتَّحْرِيْرِ، وَمَا تَصَرَّفَ مِنْهُمَا ، فَمَتَى أَتَى بِذٰلِكَ، حَصَلَ اْلعِتْقُ وَإِنْ لَمْ يَنْوِهِ، وَمَا عَدَا هَذَا مِنَ اْلأَلْفَاظِ الْمُحْتَمِلَةِ لِلْعِتْقِ كِنَايَةٌ، لاَ يَعْتِقُ بِهِ إِلاَّ إِذاَ نَوَى ، وَأَمَّا اْلفِعْلُ، فَمَنْ مَلَكَ ذَا رَحِمٍ مَحْرَمٍ عَتَقَ عَلَيْه ، وَمَنْ أَعْتَقَ جُزْءًا مِنْ عَبْدِهِ، مُشَاعًا أَوْ مُعَيَّنًا، عَتَقَ كُلُّهُ ، وَإِنْ أَعْتَقَ ذٰلِكَ مِنْ عَبْدٍ مُشْتَرَكٍ ، وَهُوَ مُوْسِرٌ بِقِيْمَةِ نَصِيْبِ شَرِيْكِهِ ، عَتَقَ كُلُّهُ وَلَهُ وَلاَؤُهُ ، وَقُوِّمَ عَلَيْهِ نَصِيْبُ شَرِيْكِهِ ، وَإِنْ كاَنَ مُعْسِرًا، لَمْ يَعْتِقْ عَلَيْهِ إِلاَّ حِصَّتُهُ؛ لِقَوْلِ رَسُوْلِ اللهِ : "مَنْ أَعْتَقَ شِرْكًا لَهُ فِيْ عَبْدٍ فَكَانَ لَهُ مَا يَبْلُغُ ثَمَنَ اْلعَبْدِ، قُوِّمَ عَلَيْهِ قِيْمَةَ عَدْلٍ، فَأَعْطَى شُرَكَاءَهُ حِصَصَهُمْ وَعَتَقَ عَلَيْهِ اْلعَبْدُ، وَإِلاَّ فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ." وَإِنْ مَلَكَ جُزْءًا مِنْ ذِيْ رَحِمِهِ، عَتَقَ عَلَيْهِ بَاقِيْهِ إِنْ كَانَ مُوْسِرًا، إِلاَّ أَنْ يَمْلِكَهُ بِالْمِيْرَاثِ، فَلاَ يَعْتِقُ عَلَيْهِ إِلاَّ مَا مَلَكَ.

فَصْلٌ فِيْ تَعْلِيْقِ اْلعِتْقِ عَلىٰ شَرْطٍ وَإِذَا قَالَ لِعَبْدِهِ: أَنْتَ حُرٌّ،فِيْ وَقْتٍ سَمَّاهُ ،أَوْ عَلَّقَ عِتْقَهُ عَلىٰ شَرْطٍ ،عَتَقَ إِذاَ جَاءَ اْلوَقْتُ أَوْ وُجِدَ الشَّرْطُ،وَلَمْ يَعْتِقْ قَبْلَهُ، وَلاَ يَمْلِكُ إِبْطَالَهُ بِاْلقَوْلِ ،وَلَهُ بَيْعُهُ وَهِبَتُهُ وَالتَّصَرُّفُ فِيْهِ، وَمَتَى عَادَ إِلَيْهِ، عَادَ الشَّرْطُ ،وَإِنْ كَانَتْ اْلأَمَةُ حَامِلاً حِيْنَ التَّعْلِيْقِ وَوُجِدَ الشَّرْطُ،عَتَقَ حَمْلُهَا ، وَإِنْ حَمَلَتْ وَوَضَعَتْ فِيْمَا بَيْنَهُمَا، لَمْ يَعْتِقْ وَلَدُهَا . ¹¹⁸⁷

1186. In this chapter, Imam Ibn Qudâmah discusses the right of the emancipator to inherit from his/her freed slave through residuary inheritance (ta‘ṣeeb) if the latter has no heirs. Please refer to the appendix on slavery.

Chapter on Emancipation Upon the Death of the Owner ¹¹⁸⁸

باَبُ التَّدْبِيْرِ

إِذَا قَالَ لِعَبْدِهِ: أَنْتَ حُرٌّ بَعْدَ مَوْتِيْ، أَوْ قَدْ دَبَّرْتُكَ، أَوْ أَنْتَ مُدَبَّرٌ صَارَ مُدَبَّرًا ، يَعْتِقُ بِمَوْتِ سَيِّدِهِ، إِنْ حَمَلَهُ الثُّلُثُ ، وَلاَ يَعْتِقُ مَا زَادَ إِلاَّ بِإِجَازَةِ اْلوَرَثَةِ ، وَلِسَيِّدِهِ بَيْعُهُ وَهِبَتُهُ وَوَطْءُ اْلجَارِيَةِ، وَمَتَى مَلَكَهُ بَعْدُ، عَادَ تَدْبِيْرُهُ ، وَمَا وَلَدَتِ الْمُدَبَّرَةُ ، وَالْمُكَاتَبَةُ ، وَأُمُّ اْلوَلَدِ مِنْ غَيْرِ سَيِّدِهَا، فَلَهُ حُكْمُهَا، وَيَجُوْزُ تَدْبِيْرُ اْلمُكَاتَبُ وَكِتَابَةُ اْلمُدَبَّرِ، فَإِنْ أَدَّى، عَتَقَ ، وَإِنْ مَاتَ سَيِّدُهُ قَبْلَ أَدَائِهِ، عَتَقَ إِنْ حَمَلَ الثُّلُثُ مَا بَقِيَ عَلَيْهِ مِنْ كِتَابَتِهِ ، وَإِلاَّ عَتَقَ مِنْهُ بِقَدْرِ الثُّلُثِ، وَسَقَطَ مِنَ اْلكِتَابَةِ بِقَدْرِ مَا عَتَقَ ، وَهُوَ عَلىٰ اْلكِتَابَةِ بِمَا بَقِيَ ، وَإِنِ اسْتَوْلَدَ مُدَبَّرَتَهُ بَطَلَ تَدْبِيْرُهَا ، وَإِنْ أَسْلَمَ مُدَبَّرُ اْلكَافِرِ أَوْ أُمُّ وَلَدِهِ، حِيْلَ بَيْنَهُ وَبَيْنَهُمَا، وَيُنْفِقُ عَلَيْهِمَا مِنْ كَسْبِهِمَا ، فَإِنْ لَمْ يَكُنْ لَهُمَا كَسْبٌ، أُجِبرَ عَلىٰ نَفَقَتِهِمَا ، فَإِنْ أَسْلَمَ، رُدَّا إِلَيْهِ ، وَإِنْ مَاتَ عُتِقَا ، وَإِنْ دَبَّرَ شِرْكًا لَهُ مِنْ عَبْدٍ وَهُوَ مُوْسِرٌ، لَمْ يَعْتِقْ سِوَى مَا أَعْتَقَهُ ، وَإِنْ أَعْتَقَهُ فِيْ مَرَضِ مَوْتِهِ وَثُلُثُهُ يَحْتَمِلُ بَاقِيَهُ، عَتَقَ جَمِيْعُهُ.

1188. In this chapter, Imam Ibn Qudâmah discusses the concept of tadbeer, which gave people a final opportunity to earn the reward of emancipation by promising a slave freedom upon the master’s death. Please refer to the appendix on slavery.

Chapter on the Emancipated by Contract ¹¹⁸⁹

باَبُ اْلمُكاَتَبِ

اْلمُكَاتَبَةُ: شِرَاءُ اْلعَبْدِ نَفْسَهُ مِنْ سَيِّدِهِ بِمَالٍ فِيْ ذِمَّتِهِ ، وَإِذَا ابْتَغَاهَا اْلعَبْدُ اْلمُكْتَسِبُ الصَّدُوْقُ مِنْ سَيِّدِهِ, اسْتُحِبَّ لَهُ إِجَابَتُهُ إِلَيْهَا؛ لِقَوْلِ اللهِ تَعَالىٰ:[وَالَّذِيْنَ يَبْتَغُوْنَ الْكِتَابَ مِمَّا مَلَكَتْ أَيْمَانُكُمْ فَكَاتِبُوْهُمْ إِنْ عَلِمْتُمْ فِيْهِمْ خَيْرًا]، وَيُجْعَلُ الْمَالُ عَلَيْهِ مُنَجَّمًّا، فَمَتَى أَدَّاهَا، عَتَقَ ، وَيُعْطَى مِمَّا كُوْتِبَ عَلَيْهِ الرُّبُعُ؛ لِقَوْلِ اللهِ تَعَالىٰ [وَآتُوْهُمْ مِنْ مَالِ اللَّهِ الَّذِيْ آتَاكُمْ] قَالَ عَلِيٌّ ÷: هُوَ الرُّبُعُ ، وَاْلمُكَاتَبُ عَبْدٌ مَا بَقِيَ عَلَيْهِ دِرْهَمٌ، إِلاَّ أَنَّهُ يَمْلِكُ اْلبَيْعَ وَالشِّرَاءَ وَالسَّفَرَ، وَكُلُّ مَا فِيْهِ مَصْلَحَةُ مَالِهِ ، وَلَيْسَ لَهُ التَّبَرُّعُ وَلاَ التَّزَوُّجُ وَلاَ التَّسَرِّيْ، إِلاَّ بِإِذْنِ سَيِّدِهِ ، وَلَيْسَ لِسَيِّدِهِ اسْتِخْدَامُهُ وَلاَ أَخْذُ شَيْءٍ مِنْ مَالِهِ، وَمَتَى أَخَذَ شَيْئًا مِنْهُ أَوْ جَنَى عَلَيْهِ أَوْ عَلىٰ مَالِهِ، فَعَلَيْهِ غَرَامَتُهُ ،وَيَجْرِيْ الرِّبَا بَيْنَهُمَا، كَاْلأَجَانِبِ ، إِلاَّ أَنَّهُ لاَ بَأْسَ عَلَيْهِ أَنْ يُعَجِّلَ لِسَيِّدِهِ، وَيَضَعُ عَنْهُ بَعْضَ كِتَابَتِهِ، وَلَيْسَ لَهُ وَطْءُ مُكَاتَبَتِهِ، وَلاَ بِنْتِهَا وَلاَ جَارِيَتِهَا ،فَإِنْ فَعَلَ، فَعَلَيْهِ مَهْرُ مِثْلِهَا، وَإِنْ وَلَدَتْ مِنْهُ، صَارَ أُمَّ وَلَدٍ، فَإِنْ أَدَّتْ عَتَقَتْ، وَإِنْ مَاتَ سَيِّدُهَا قَبْلَ أَدَائِهَا، عَتَقَتْ ،وَمَا فِيْ يَدِهَا لَهَا إِلاَّ أَنْ تَكُوْنَ قَدْ عَجَزَتْ. وَيَجُوْزُ بَيْعُ الْمُكَاتَبِ؛ لِأَنَّ عَائِشَةَ رَضِيَ اللهُ عَنْهَا اشْتَرَتْ بَرِيْرَةَ وَهِيَ مُكَاتَبَةٌ، بِأَمْرِ رَسُوْلِ اللهِ ،وَيَكُوْنُ فِيْ يَدِ مُشْتَرِيْهِ مُبْقًى عَلىٰ مَا بَقِيَ مِنْ كِتَابَتِهِ، فَإِنْ أَدَّى، عَتَقَ وَوَلاَؤُهُ لِمُشْتَرِيْهِ، وَإِنْ عَجَزَ، فَهُوَ عَبْدٌ لَهُ ، وَإِنِ اشْتَرَى اْلمُكَاتَبَانِ كُلُّ وَاحِدٍ مِنْهُمَا اْلآخَرَ، صَحَّ شِرَاءُ اْلأَوَّلِ وَبَطَلَ الثَّانِيْ ، فَإِنْ جُهِلَ اْلأَوَّلُ مِنْهُمَا، بَطَلَ اْلبَيْعَانِ ، وَإِنْ مَاتَ اْلمُكَاتَبُ، بَطَلَتِ اْلمُكَاتَبَةُ ، وَإِنْ مَاتَ السَّيِّدُ قَبْلَهُ، فَهُوَ عَلىٰ كِتاَبَتِهِ يُؤَدِّيْ إِلىٰ اْلوَرَثَةِ، وَوَلاَؤُهُ لِمُكَاتِبِهِ ، وَاْلكِتَابَةُ عَقْدٌ لاَزِمٌ لَيْسَ لِأَحَدِهِمَا فَسْخُهَا، وَإِنْ حَلَّ نَجْمٌ فَلَمْ يُؤَدِّهِ، فَلِسَيِّدِهِ تَعْجِيْزُهُ ، وَإِذَا جَنَى الْمُكَاتَبُ، بُدِئَ بِجِنَايَتِهِ ، وَإِنِ اخْتَلَفَ هُوَ وَسَيِّدُهُ فِيْ اْلكِتَابَةِ ، أَوْ عِوَضِهَا ، أَوِ التَّدْبِيْرِ، أَوِ اْلاِسْتِيْلاَدِ، فَاْلقَوْلُ قَوْلُ السَّيِّدِ مَعَ يَمِيْنِهِ.

1189. In this chapter, Imam Ibn Qudâmah discusses emancipation by contract, where slaves purchased their freedom from the owner with money they earned while still in slavery. Please refer to the appendix on slavery.

Chapter on the Mothers of Children ¹¹⁹⁰

بَابُ حُكْمِ أُمَّهَاتِ اْلأَوْلاَدِ

إِذَا حَمَلَتِ اْلأَمَةُ مِنْ سَيِّدِهَا فَوَضَعَتْ مَا تَبَيَّنَ فِيْهِ شَيْءٌ مِنْ خَلْقِ اْلإِنْسَانِ، صَارَتْ بِذَلِكَ أُمُ وَلَدٍ. تَعْتِقُ بِمَوْتِهِ، وَإِنْ لَمْ يَمْلِكْ غَيْرَهَا، وَمَادَامَ حَيًّا، فَهِيَ أَمَتُهُ، أَحْكَامُهَا أَحْكَامُ اْلإِمَاءِ، فِيْ حِلِّ وَطْئِهَا وَمِلْكِ مَنَافِعِهَا وَكَسْبِهَا وَسَائِرِ اْلأَحْكَامِ، إِلاَّ أَنَّهُ لاَ يَمْلِكُ بَيْعَهَا وَلاَ رَهْنَهَا وَلاَ سَائِرَ مَا يَنْقُلُ اْلمِلْكَ فِيْهَا أَوْ يُرَادُ لَه، وَتَجُوْزُ اْلوَصِيَّةُ لَهَا وَإِلَيْهَا. وَإِنْ قَتَلَتْ سَيِّدَهَا عَمْدًا، فَعَلَيْهَا اْلقِصَاصُ، وَإِنْ قَتَلَتْهُ خَطَأً، فَعَلَيْهَا قِيْمَةُ نَفْسِهَا، وَتَعْتِقُ فِي اْلحَالَيْنِ. وَإِنْ وَطِئَ أَمَةَ غَيْرِهِ بِنِكَاحٍ ثُمَّ مَلَكَهَا حَامِلاً، عَتَقَ اْلجَنِيْنُ، وَلَهُ بَيْعُهَا.
