Fighting the Insurgent Rebels

These are the insurgents who rebel against the imam (rightful ruler), wanting to depose him. The Muslims are required to support their imam in deterring them by the lightest means sufficient for deterrence. If this results in a fight against them or the destruction of their property, there is no liability on the defender, and if the defender dies, he is a martyr.

وَهُمُ: اْلخَارِجُوْنَ عَلىٰ اْلإِمَامِ، يُرِيْدُوْنَ إِزَالَتَهُ عَنْ مَنْصِبِهِ، فَعَلَى اْلمُسْلِمِيْنَ مَعُوْنَةُ إِمَامِهِمْ فِيْ دَفْعِهِمْ بِأَسْهَلِ مَايَنْدَفِعُوْنَ بِهِ، فَإِنْ آلَ إِلىٰ قَتْلِهِمْ، أَوْ تَلَفِ مَالِهِمْ، فَلاَ شَيْءَ عَلىٰ الدَّافِعِ، وَإِنْ قُتِلَ الدَّافِعُ كَانَ شَهِيْدًا.

Those of them who retreat should not be pursued, and those who are wounded should not be killed. Their property is not seized as war spoils, and their families are not enslaved. Those of them who are killed should be washed, shrouded and have a janâzah (funeral) prayer offered for them.

وَلاَ يُتْبَعُ لَهُمْ مُدْبِرٌ، وَلاَ يُجهَزُ عَلىٰ جَرِيْحٍ، وَلاَ يُغْنَمُ لَهُمْ مَالٌ، وَلاَ تُسْبَى لَهُمْ ذُرِّيَّةٌ. وَمَنْ قُتِلَ مِنْهُمْ غُسِّلَ وَكُفِّنَ وَصُلِّيَ عَلَيْهِ.

Neither of the two parties is held liable for damage to lives and properties that they caused during the war.

وَلاَ ضَمَانَ عَلىٰ أَحَدِ اْلفَرِيْقَيْنِ فِيْمَا أَتْلَفَ حَالَ اْلحَرْبِ، مِنْ نَفْسٍ أَوْ مَالٍ.

Whatever the rebels had taken while in power – zakat, jizyah (tax on non-Muslims living under the protection of a Muslim government), or kharâj (agricultural tax) – is not collected from them or from those who paid them. The judgments issued by their judges are not reversed except in the same way as judgments of any other judges would be. 1661

وَمَا أَخَذَ اْلبُغَاةُ حَال امْتِنَاعِهِمْ مِنْ زَكَاةٍ، أَوْ جِزْيَةٍ،أَوْ خَرَاجٍ لَمْ يُعَدْ عَلَيْهِمْ، وَلاَ عَلىٰ الدَّافِعِ إِلَيْهِمْ، وَلاَ يُنْقَضُ مِنْ حُكْمِ حَاكِمِهِمْ، إِلاَّ مَا يُنْقَضُ مِنْ حُكْمِ غَيْرِهِ.

1661. Judgments are reversed only if they are not supported by an acceptable ijtihâd.
